TEMPORARY NON-IMMIGRANT WORK VISAS

This type of immigration benefit is for individuals who wish work in the United States temporarily. There are different types of work visas depending on the nature of the work to be performed, the duration of the visa, and the type of training or education required to carry out the activity. Among the most important types of work visas are the following:

1. H1-B Visa for Professionals - Specialized Occupations
2. L - 1A Visa Transfer of Executives or Managers
3. E - 2 Visa for Investors
4. O - 1 Visa for Individuals with Extraordinary Abilities

The H-1B category is a type of visa that allows American employers to sponsor and temporarily hire foreign professionals for specialized occupations for up to a maximum total period of 6 years. This visa is subject to an annual cap of 65,000 visas per fiscal year and given the demand for the program, it is necessary for the employer to register within a specific period of time, generally during the month of March of every year.

The L-1A visa category is intended to transfer executives or managers of multinational companies from the foreign parent company to a subsidiary, branch, or affiliate in the United States for a maximum total period of 7 years. The candidate must have held an executive or managerial position for one continuous year within the last three years for the foreign company, which must be related to the American company from the point of view of control and ownership of both companies.

This category is for individuals who are nationals of countries with a Navigation and Commerce Treaty with the United States and who are in the process of investing or have invested a substantial amount of capital in a US company. The validity period of the E-2 visa depends on the terms of the treaty between the country of the investor's nationality and the United States, which can be between 3 to 60 months. 

The O-1 visa category is for people with extraordinary abilities in the areas of Science, Education, Business or Sports and who can demonstrate achievements and recognition in their areas of specialization. The candidate's extraordinary abilities must be demonstrated through evidence showing that the foreign national has received awards at a national or international level, membership in professional associations that requires outstanding achievements by its members, that major professional journals have published their work, have had significant contributions to the field of expertise, have had their written articles published in major journals, have held a leadership position in distinguished organizations, or have a significantly high salary compared to others colleagues in the field. This visa is generally initially granted for three years and can be extended without limit on the number of extensions, one year at a time, as long as proof of continued employment can be provided.
